Terms and Conditions 

Article 1 (Scope of Application)

  1. 1.

    Contracts for Accommodation and related agreements to be concluded between this Hotel and the Guest to be accommodated shall be subject to the provisions of these Terms and Conditions, and any matters not provided for in these Terms and Conditions shall be governed by laws and regulations (meaning laws and regulations or those based on laws and regulations; the same applies hereinafter) or generally accepted practices.

  2. 2.

    In the event that the Hotel has entered into a special contract with a Guest insofar as such special contract does not violate laws and regulations and generally accepted practices, notwithstanding the provisions of the preceding Paragraph, the special contract shall take precedence over the provisions of the preceding Paragraph.

Article 2 (Application for Accommodation Contract)

  1. 1.

    A Guest who intends to apply for an Accommodation Contract with the Hotel shall provide the Hotel with the following particulars:

    1. (1)

      Guest name

    2. (2)

      Date of stay and expected arrival time

    3. (3)

      Accommodation fees (in principle based on the basic accommodation fees in Appendix 1)

    4. (4)

      Other particulars deemed necessary by the Hotel

  2. 2.

    If a Guest requests, during his/her stay, to extend his/her stay beyond the date specified in subparagraph 2 of the preceding paragraph, the Hotel will treat it as if he/she had made an application for a new Accommodation Contract at the time such request was made.

Article 3 (Establishment of Accommodation Contracts, etc.)

  1. 1.

    An accommodation contract shall be deemed to have been established when the Hotel accepts the application as stipulated in the preceding Article. However, this shall not apply when the Hotel proves that it has not accepted the application.

  2. 2.

    When an Accommodation Contract has been established in accordance with the provisions of the preceding paragraph, an application fee set by the Hotel, within the limits of the basic accommodation charges for the entire stay (if the stay exceeds 3 days, then 3 days), shall be paid by the date specified by the Hotel.

  3. 3.

    The application fee will first be applied to the accommodation fee to be paid by the guest in full, and in the event that a situation occurs to which the provisions of Article 6 and Article 18 apply, it will be applied in the order of penalty charges and compensation, and the remaining balance, if any, will be refunded at the time of payment of the accommodation fee as provided for in Article 12.

  4. 4.

    If the application fee stipulated in Paragraph 2 is not paid by the date specified by the Hotel pursuant to the provisions of the same Paragraph, the Accommodation Contract shall become invalid, provided, however, that the Hotel has so notified the Guest when specifying the due date for payment of the application fee.

Article 4 (Special agreement not requiring payment of application fee)

  1. 1.

    Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special contract requiring no accommodation deposit after the Contract has been concluded.

  2. 2.

    If the Hotel has not requested the payment of the application fee as stipulated in Paragraph 2 of the preceding Article and/or has not specified the due date for the payment of the application fee at the time of accepting the application for an Accommodation Contract, it will be treated as if the Hotel has accepted a special contract as stipulated in the preceding Paragraph.

Article 4-2 (Request for cooperation in infection prevention measures at facilities)

The Hotel may request cooperation from Guests seeking accommodation pursuant to the provisions of Article 4-2, Paragraph 1 of the Inns and Hotels Act (Act No. 138 of 1948).

Article 5 (Refusal to Conclude an Accommodation Contract)

  1. 1.

    The Hotel may refuse to enter into an accommodation contract in the following cases. However, this does not mean that the Hotel may refuse accommodation in cases other than those listed in Article 5 of the Inns and Hotels Act.

    1. (1)

      When the application for accommodation does not conform to these terms and conditions.

    2. (2)

      When the Hotel is fully booked and there are no rooms available.

    3. (3)

      When the person seeking accommodation is deemed liable to conduct himself/herself in a manner that will violate the provisions of the law, the public order or good morals in regard to his/her accommodation.

    4. (4)

      When the person seeking accommodation is deemed to fall under any of the following items (A) to (C):

      1. A

        An organized crime group as defined in Article 2, Paragraph 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991) (hereinafter referred to as an "organized crime group"), an organized crime member as defined in Article 2, Paragraph 6 of the same Act (hereinafter referred to as an "organized crime member"), an associate member of an organized crime group, or a person related to an organized crime group, or other anti-social forces.

      2. B

        When a corporation or other organization whose business activities are controlled by an organized crime group or an organized crime member

      3. C

        A corporation in which any of its directors is a member of an organized crime group

    5. (5)

      When a person seeking accommodation behaves in a manner that is extremely disruptive to other guests.

    6. (6)

      When the person seeking accommodation is a patient of a specific infectious disease as defined in Article 4-2, Paragraph 1, Item 2 of the Inns and Hotels Act (hereinafter referred to as "patients of a specific infectious disease").

    7. (7)

      When violent demands are made regarding accommodation or an unreasonable burden is requested (excluding cases where the person seeking accommodation requests the removal of social barriers pursuant to the provisions of Article 7, Paragraph 2 or Article 8, Paragraph 2 of the Act on Promotion of Elimination of Disability Discrimination (Act No. 65 of 2013; hereinafter referred to as the "Disability Discrimination Act").

    8. (8)

      When the Guest seeking accommodation repeatedly makes requests to the Hotel that are deemed to be excessively burdensome and likely to significantly impede the provision of accommodation services to other Guests as specified in Article 5-6 of the Regulations for Enforcement of the Inns and Hotels Act.

    9. (9)

      When it is impossible to provide accommodation due to natural disasters, malfunctions of facilities, or other unavoidable reasons.

    10. (10)

      When the circumstances fall under Article 14 of the Fukuoka Prefecture Hotel and Inn Business Act.

Article 5-2 (Explanation of Refusal to Conclude an Accommodation Contract)

If the Hotel does not agree to the conclusion of an Accommodation Contract in accordance with the preceding Article, a Guest seeking accommodation may request an explanation from the Hotel.

Article 6 (Guest's right to cancel accommodation contract)

  1. 1.

    The Guest is entitled to cancel the Accommodation Contract by notifying the Hotel.

  2. 2.

    In the event that the Guest cancels the Accommodation Contract in whole or in part due to reasons attributable to the Guest (except in the case where the Hotel has specified a due date for the application fee and requested payment pursuant to the provisions of Article 3, Paragraph 2 and the Guest cancels the Accommodation Contract prior to payment), the Guest shall pay a penalty as listed in Attached Table 2. However, in the event that the Hotel has entered into a special contract as set forth in Article 4, Paragraph 1, this shall apply only if the Hotel has notified the Guest of his/her obligation to pay a penalty in the event that the Guest cancels the Accommodation Contract, in accordance with the special contract.

  3. 3.

    If a Guest does not arrive by 6 p.m. on the day of the stay without contacting the Hotel (or by two hours after the expected time of arrival if the Guest has stated such time in advance), the Hotel may regard the Accommodation Contract as having been cancelled by the Guest.

  4. 4.

    When a guest contacts the hotel to cancel an accommodation contract, the hotel will confirm the details of the request and then send a cancellation completion notice by email. The cancellation will be considered to have been officially completed when the guest confirms receipt of the notice by telephone. If the notice email is not received or the guest is unable to confirm the cancellation, the cancellation will be put on hold for the time being, and the cancellation will be considered to have been completed when receipt of the notice is confirmed.

Article 7 (Hotel's right to cancel contract)

  1. 1.

    The Hotel may cancel the Accommodation Contract in the following cases. However, this paragraph does not mean that the Hotel may refuse accommodation in cases other than those listed in Article 5 of the Inns and Hotels Act.

    1. (1)

      When the Guest is deemed liable to conduct himself/herself in a manner that will violate the laws, public order or good morals in regard to his/her accommodation, or when he/she is deemed to have already conducted such conduct.

    2. (2)

      When the Guest is considered to be one of the following (A) to (C):

      1. A

        Organized crime group, organized crime group member, associate member of an organized crime group, or related person to an organized crime group or other antisocial forces

      2. B

        When a corporation or other organization whose business activities are controlled by an organized crime group or an organized crime member

      3. C

        A corporation in which any of its directors is a member of an organized crime group

    3. (3)

      When the guest behaves in a manner that causes significant inconvenience to other guests.

    4. (4)

      When the guest is a patient of a specific infectious disease.

    5. (5)

      When the guest makes violent demands on the hotel or the hotel staff, or requests an unreasonable burden (excluding cases where the guest requests the removal of social barriers pursuant to the provisions of Article 7, Paragraph 2 or Article 8, Paragraph 2 of the Act on the Elimination of Discrimination against Persons with Disabilities).

    6. (6)

      When the Guest has repeatedly made requests to the Hotel that are deemed to be excessively burdensome and may significantly impede the provision of accommodation services to other Guests as specified in Article 5-6 of the Regulations for Enforcement of the Inns and Hotels Act.

    7. (7)

      When it is impossible to provide accommodation due to a natural disaster or other force majeure event.

    8. (8)

      When the circumstances fall under Article 14 of the Fukuoka Prefecture Hotel and Inn Business Act.

    9. (9)

      When the Guest smokes in bed, tampers with fire-fighting equipment, etc., or fails to observe any other prohibited activities stipulated in the Usage Regulations stipulated by the Hotel (limited to those necessary for fire prevention purposes).

  2. 2.

    When the Hotel has cancelled the Accommodation Contract in accordance with the preceding paragraph, the Hotel shall not charge the Guest for any accommodation services etc. which he has not yet received.

Article 7-2 (Explanation of cancellation of accommodation contract)

In the event that the Hotel cancels the Accommodation Contract in accordance with the preceding Article, the Guest may request the Hotel to explain the reason.

Article 8 (Accommodation Registration)

  1. 1.

    The Guest will be required to register the following particulars at the Hotel front desk on the day of accommodation:

    1. (1)

      Name, address and contact details of the guest

    2. (2)

      For foreigners who do not have an address in Japan, nationality and passport number

    3. (3)

      Other particulars deemed necessary by the Hotel

  2. 2.

    If the Guest intends to pay the charges prescribed in Article 12 by any means other than Japanese currency, such as traveller's cheques, accommodation coupons or credit card, these shall be presented in advance at the time of registration prescribed in the preceding Paragraph.

Article 9 (Guest Room Occupancy Hours)

  1. 1.

    Guests may occupy the hotel guest rooms from 15:00 to 12:00 the following day. However, in the case of consecutive stays, guests may occupy the guest rooms all day, except on the days of arrival and departure.

  2. 2.

    Notwithstanding the provisions of the preceding paragraph, the Hotel may accommodate guests occupying their rooms outside the hours specified in the same paragraph.
    In this case, the following additional fees will be charged:

    1. (1)

      Up to 3 hours overage: 30% of the room rate

    2. (2)

      Overtime of 3 to 5 hours: 50% of the room rate

    3. (3)

      Over 5 hours: 100% of the room rate

Article 10 (Observance of Terms of Use)

Guests are required to abide by the terms of use displayed on the TV or iPad in their guest rooms and on the hotel website while staying at the hotel.

Article 11 (Business Hours)

The opening hours of our hotel facilities will be posted on the iPads in the guest rooms and on our website.

Article 12 (Payment of Fees)

  1. 1.

    The breakdown of the accommodation fees, etc. to be paid by the Guest shall be as set forth in Attached Table 1.

  2. 2.

    Payment of accommodation fees, etc. as stipulated in the preceding paragraph shall be made in Japanese currency or by any other means acceptable to the Hotel, such as traveller's cheques, accommodation coupons, credit cards, etc., at the time of the Guest's departure or at the front desk upon request by the Hotel.

  3. 3.

    Accommodation fees will be charged even if the Guest voluntarily does not stay after the Hotel has provided the guest room to the Guest and made it available for use.

Article 13 (Liability of the Hotel)

  1. 1.

    The Hotel shall compensate the Guest for damages caused to the Guest in the fulfillment or nonfulfillment of the Accommodation Contract and/or related agreements, unless such damages have been caused by reasons beyond the Hotel's control.

  2. 2.

    Our hotel regularly conducts fire prevention inspections in accordance with fire safety laws and regulations, and is also covered by liability insurance to cover the unlikely event of a fire or other disaster.

Article 14 (Handling when contracted rooms cannot be provided)

  1. 1.

    When the Hotel is unable to provide a contracted room to a Guest, it will arrange, where possible, for the Guest to stay in accommodation of similar standards elsewhere, with the Guest's consent.

  2. 2.

    Notwithstanding the provisions of the preceding paragraph, if the Hotel is unable to arrange alternative accommodations for the Guest, the Hotel shall pay the Guest a compensation fee equivalent to the breach of contract charges, which shall be applied to the reparations. However, if the Hotel is unable to provide a room due to reasons beyond the Hotel's control, the Hotel shall not pay the compensation fee.

Article 15 (Handling of Deposited Items, etc.)

  1. 1.

    When loss, breakage or other damage is caused to goods, cash or valuables deposited by the Guest at the front cashier, the Hotel shall compensate for such damage up to the maximum of 150,000 yen, except in cases where this has occurred due to acts of force majeure.

  2. 2.

    The Hotel shall compensate for damages incurred when loss, breakage or other damage occurs due to the Hotel's intention or negligence regarding goods, cash or valuables brought into the Hotel by the Guest and not deposited in the Front Desk Safety Deposit Box. However, the Hotel shall not compensate for damages for items whose type and value have not been reported in advance by the Guest, except in cases where the Hotel has done so intentionally or with gross negligence.

Article 16 (Care of Guest's Baggage and Belongings)

  1. 1.

    When the baggage of the Guest is brought into the Hotel prior to his/her arrival, the Hotel shall be liable to store it only in cases where the Hotel has agreed to this in advance and shall hand it over to the Guest at the front desk at the time of his/her check-in.

  2. 2.

    If a guest leaves behind cash or valuables (※) at the hotel after checking out, the hotel will, in principle, keep them for seven days, including the day they are found, and then turn them over to the nearest police station. Other items will be disposed of one month later. However, food, drinks, tobacco, magazines, etc. will be disposed of the day after check-out.
    *"Cash and valuables" refers to items that have a certain value, such as wallets (cash), credit cards, cameras, mobile phones, watches, precious metals, prepaid cards, etc., as well as items that may be misused by a third party, such as driver's licenses and insurance cards.

  3. 3.

    The liability of the Hotel regarding the custody of the Guest's baggage and belongings in the cases of the preceding two Paragraphs shall be in accordance with the provisions of Paragraph 1 of the preceding Article in the case of Paragraph 1, and with the provisions of Paragraph 2 of the same Article in the case of the preceding Paragraph.

Article 17 (Parking Responsibility)

When a guest uses the hotel's parking lot, regardless of whether the key to the vehicle has been deposited with the hotel, the hotel is merely lending the space and is not responsible for the management of the vehicle. However, if the hotel causes damage through intentional or negligent acts on the part of the hotel in managing the parking lot, the hotel will be liable for compensation.

Article 18 (Guest Liability)

When the Hotel suffers damage caused through intention or negligence on the part of the Guest, the Guest will compensate the Hotel for such damage.

Article 19 (Disclaimer)

Guests are responsible for their own use of computer communications within the hotel. Our company will not be held responsible for any damages suffered by users as a result of service interruptions caused by system failures or other reasons during the use of computer communications. Furthermore, if damages are caused to our company or third parties as a result of actions that our company deems inappropriate in the use of computer communications, guests will be required to compensate for such damages.

Article 20 (Personal information protection)

Personal information disclosed by guests in connection with the accommodation contract will be managed in accordance with the Act on the Protection of Personal Information.

Article 21 (Preferred language)

These terms and conditions are written in both Japanese and English, however, in the event of any inconsistency or discrepancy between the two versions of the terms and conditions, the Japanese version shall prevail.

The accommodation tax rate is based on the accommodation fee (excluding consumption tax and service charges) per person per night.

The accommodation fee for the accommodation tax is the price for a room only, excluding meals etc.

    The percentage indicates the ratio of the penalty to the basic accommodation fee.

    If the number of contract days is shortened, a penalty for one day (the first day) will be charged regardless of the number of days shortened.
